NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN pursuant to N.C. Gen. Stat. §158-7.1 that the Mills River Town Council will hold a public hearing on October 23, 2025, at 6:30 P.M. to consider participation in the commercial property assessed capital expenditure (C-PACE) program.

The C-PACE Act authorizes the North Carolina Department of Commerce (the “Program Sponsor”) to oversee the C-PACE Program and requires the Economic Development Partnership of North Carolina, Inc., a North Carolina nonprofit corporation (the “Statewide Administrator”), to administer the C-PACE Program and, in support thereof, provide certain administrative services described in N.C. Gen. Stat. § 160A-239.14.

The C-PACE Act and C-PACE Program permit willing owners of commercial, industrial, or agricultural real property, or residential real property with five or more dwelling units located in the jurisdictional boundaries of participating local governments (“Qualifying Commercial Property”) to obtain direct financing (“C-PACE Financing”) from a “capital provider” (as further defined in N.C. Gen. Stat. § 160A-239.12(1), “Capital Provider”) for “qualifying improvements” (as further defined in N.C. Gen. Stat. § 160A-239.12(14), “Qualifying Improvements”) approved by the Program Sponsor, including energy efficiency measures, resiliency measures, renewable energy measures, and water conservation measures.

REQUEST FOR RELEASE OF FUNDS
On or about October 1, the City of Hendersonville's Community Development Department will authorize the Housing Assistance Corporation to submit a request to the Self-Help Homeownership Opportunity Program (SHOP) to fund the land acquisition for single-family development. The purpose of the project is to construct 6 single-family homes for low-income households, which are defined as households at or below 80% of the area median income, on Wilmont Drive in Hendersonville, North Carolina. The estimated total cost of the project is $1,650,000, with $125,000 in support from SHOP funds.

NO SIGNIFICANT IMPACT
The City of Hendersonville encourages the public's participation and welcomes comments on the determination of no potential effects on historic or cultural resources for the proposed project. This documentation is available for public inspection at the City of Hendersonville's Community Development Department, 100 North King Street, and on the city's website (www.hendersonvillenc.gov). PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the Community Development Department. ENVIRONMENTAL CERTIFICATION
The Community Development Department certifies to SHOP that Mr. Lew Holloway, in his capacity as Director, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Self-Help Homeownership Opportunity Program’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Housing Assistance Corporation to use Program funds.

OBJECTIONS
The Self-Help Homeownership Opportunity Program will accept objections to the Responsible Entity's (RE) Request for Release of Funds and Environmental Certification for a period of fifteen days following the submission dote or its actual receipt of the request (whichever is later) only if they ore on one of the following bases: (a) the certification was not executed by the Certifying Officer of the RE; (bl the RE has omitted a step or failed to make a determination or finding required by HUD regulations at 24 CFR part 58; (cl the RE has omitted one or more steps in the preparation, completion or publication of the Environmental Assessment or Environmental Impact Study per 24 CFR Subparts E, F or G of Part 58, as applicable; (dl the grant recipient or other participants in the development process hove committed funds, incurred costs or undertaken activities not authorized by 24 CFR Port 58 before approval of a release of funds and approval of the environmental certification; (e) another Federal agency acting pursuant to 40 CFR Port 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Henderson County is soliciting services from qualified engineers to provide engineering and design services, for the Blue Ridge Community College Water and Sewer Extension, in Flat Rock, NC. The nature of the relief being sought is as follows: To determine ownership interests and partition of a two certain tracts or parcels of land lying and being in Henderson County, North Carolina, and more particularly described as follows:

PARCEL/TRACT ONE
BEGINNING at a stake in the center of the Crab Creek Road (or Kanuga Road) said stake being the northwest corner of the Lamar Paxson property and runs thence with said road South 55° 45’ West 250 feet to a stake; thence leaving said road and running thence South 34° East 1284.5 feet to a stake; thence due East 1494 feet to the center of Mud Creek; thence down said Creek North 6° East 1420 feet to a stake, the original northeast corner of the M.C. King boundary, said stake also being W. C. Hathcock’s southeast corner; thence with the original King line North 87° West 528 feet to a stake and North 86° 30’ West 252 feet to a stake, Paxson’s southeast corner; thence with Paxson’s line South 56° West 1261 feet to a stake, Paxson’s southwest corner; thence with Paxson’s southwest boundary line North 34° West 574.5 feet to the point of beginning, and containing 50 acres, more or less.

LESS and EXCEPTING that 4.71 acre tract of land as described in Deed Book 557 at Page 641, Henderson County Registry.

LESS and EXCEPTING that 14.6 acre (more or less) tract of land as described in Deed Book 503 at Page 379, Henderson County Registry.

TOGETHER WITH and SUBJECT TO that 30 foot right of way described as follows: Beginning at the point of beginning of the property described in Deed Book 231 at Page 472, Henderson County Registry, thence with the north lines, South 34 deg. East 574.5 feet and North 56 deg. East to the corner of 14.6 acre tract.

BEING a portion of that property as described in Deed Book 231 at Page 472, Henderson County Registry.

Subject to restrictions, right of ways, and easements of record.

PARCEL/TRACT TWO
Being that 88-acre tract described in deed from W.K. Lanning et al to R.M. Pryor, said deed being recorded in Deed Book 155 at Page 194, Henderson County Registry.

LESS and EXCEPTING all of that 10-1/2 acre tract described in deed from W.K. Lanning et ux to R. M. Pryor, said deed being recorded in Deed Book 177 at Page 3, Henderson County Registry.

BEING a portion of that property as described in Deed Book 393 at Page 365, Henderson County Registry.
Bounded on the north by Owen Reese Tract of land; on the east by other lands of said parties of the first part; on south by W. D. Coker estate and on west by Bellefield Public Road, and being more particularly described as follows: Beginning at an Iron Stake on the aforesaid Bellefield Public Road, in line of W. D. Coker estate and in southwest corner of tract of land herein described and running thence along said Bellefield Public Road N 20 degrees 15 minutes E 624 feet, thence still along said road N 17 degrees 15 minutes E 668 feet, thence still along said road, N 11 degrees 30 minutes E 148 feet to stake in line of Owen Reese Tract of land, thence along line of Owen Reese Tract of land S 51 degrees E 146 feet to stake, thence along chopped line S 02 degrees W 500 feet to another stake, thence S 72 degrees 30 minutes E 2025 feet to a stake between a Black Gum and a Sweet Gum corner, thence S 17 degrees 45 minutes W 1332 feet to line of W. D. Coker estate at a blown down oak with lightwood stake in stump hole, thence along line of W. D. Coker estate N 56 degrees 30 minutes W 233 feet to pine, thence N 63 degrees W 353 feet to another pine, N 65 degrees 15 minutes W 236 feet to another pine, N 58 degrees 15 minutes W 390 feet to stake, N 63 degrees 15 minutes W 561 feet to another stake, N 64 degrees 15 minutes W 561 feet to stake at the point of beginning on the aforesaid Bellefield Public Road, and containing 60 acres, more or less, as surveyed by C. R. Revelle & Son in December, 1944.

You are required to make defense to such pleading no later than November 10, 2025 and upon your failure to do so the party seeking service against you will apply to the court for the relief sought.
